By this Act the terms «conviction» and «sentence» are eliminated from juvenile Court procedure; no delinquent under the age of 17 years of age may commited to penal servitude and no one under the age of 17 years may be imprisoned unless the Court certifies that he is of so depraved or unruly a character that he cannot be detained in a remand home or otherwise dealt with. No offender under 18 years of age may be sentenced to death. In English law the idea of punishment has not yet been entirely eliminated from the treatment of juvenile delinquents for the Courts still possess power to order whipping. The power is little used, however.
